Executive Summary & Key Protections
Satkosh is an automated backup and disaster recovery platform. By default, your backup content is encrypted locally on your machine before transmission and sent directly to your chosen storage repository. Serverstock never inspects, accesses, or decrypts your backup archives. You retain 100% data ownership with zero vendor lock-in.
1. Parties & Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement governing access to and use of the Satkosh automated backup and disaster recovery platform ("Satkosh" or the "Service"), provided by Serverstock Datacenter Private Limited ("Serverstock", "we", "us", "our"), a company incorporated under the Companies Act, 2013, with its principal place of business at Nashik, Maharashtra, India.
These Terms apply to the entity or individual subscribing to the Service ("Customer", "you") and to every authorized administrative or operator account provisioned under that subscription. By installing the Agent software, registering an account, or accessing the Satkosh Management Console, you acknowledge and agree to be bound by these Terms.
Where we process personal data on your behalf as a Data Processor, our Data Processing Agreement (DPA) applies concurrently and, in the event of any conflict on data privacy matters, the DPA shall prevail.

3. Service Architecture & Encryption
Satkosh performs automated, scheduled, and on-demand backups of designated Windows and Linux machines and executes recovery procedures upon authorized instruction.
Client-Side Encryption Guarantee: Backup Content is encrypted locally on the source machine (AES-256) before transmission and written directly to your chosen Storage Target. Serverstock cannot inspect, access, or decrypt your encrypted backup archives.
We continuously maintain, optimize, and update the Service. In the event of any planned maintenance or architectural modifications that could materially affect production workflows, we will provide advance electronic notification.
4. Storage Models & Data Sovereignty
4.1 Bring Your Own Storage (BYOS)
Where you configure a self-managed Storage Target (e.g. your own Amazon S3, MinIO, Wasabi, or on-premises NAS):
- You maintain sole ownership, configuration, billing, and access control over the storage repository.
- Serverstock holds only the encrypted access credentials required to facilitate automated Agent uploads.
- We are not responsible for storage provider outages, billing disputes, or data loss caused by third-party storage deletions.
4.2 Satkosh Managed Cloud Storage (India Datacenters)
Where you purchase managed storage directly through Satkosh:
- Sovereign Indian Residency: All backup snapshots and chunk repositories are stored strictly within certified Tier-3/Tier-4 datacenter facilities in India (e.g. Mumbai/Western India region).
- No Vendor Lock-In & Zero Egress Fees: You may download, restore, or migrate your archives to your own storage at any time with zero penalty or bandwidth egress surcharges.
- Post-Termination Export Grace Period: Following subscription termination, we maintain a 30-day read-only grace window allowing complete export before irreversible cryptographic erasure.
5. Immutable Retention
Satkosh allows customers to enforce Immutable Retention on supported Storage Targets. When enabled:
- Protected backup snapshots cannot be altered, overwritten, or purged by any entity, including root administrative accounts, ransomware payloads, or Serverstock engineers, until the configured retention timer expires.
- Customers acknowledge that immutable objects continue to consume physical storage capacity until their expiration, and cannot be prematurely deleted to reduce capacity charges.
6. Customer Responsibilities & Acceptable Use
You agree to:
- Maintain the confidentiality of console administrative credentials and enforce Multi-Factor Authentication (MFA) across all operator accounts.
- Securely store any encryption password you hold. Where you select zero-knowledge encryption the password is held by you alone, and a lost password cannot be recovered by Serverstock. Where you use managed encryption we store the password on your behalf and can supply it to you on request.
- Ensure you hold all legal rights, consents, and authorizations required to back up the data stored on protected systems.
- Refrain from reverse engineering, decompiling, or attempting unauthorized access to the Platform infrastructure.
7. Fees, Subscriptions & Invoicing
- Subscription Rates: Fees are billed monthly in Indian Rupees (₹ INR) based on the number of active protected machines (workstations and servers) plus contracted storage capacity (if utilizing Satkosh Cloud Storage).
- Payment Terms: Invoices are issued electronically at the beginning of each billing cycle and are payable within thirty (30) days of receipt unless otherwise agreed in an enterprise order form.
- Taxes: All quoted rates are exclusive of applicable Goods and Services Tax (GST), which will be invoiced at statutory rates.
8. Limitation of Liability & Warranties
Satkosh is provided with commercially reasonable skill and care. Except as expressly provided herein, the Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by applicable law in India, neither party shall be liable for indirect, incidental, consequential, or punitive damages. Serverstock's total cumulative liability under these Terms shall be limited to the aggregate fees paid by the Customer in the twelve (12) months preceding the incident giving rise to the claim.
9. Term, Suspension & Termination
- Term: Subscriptions renew automatically on a month-to-month or annual basis.
- Termination for Convenience: Either party may terminate a monthly subscription upon thirty (30) days' prior written notice.
- Data Deletion: Following the 30-day post-termination export window, all customer storage partitions and metadata records are irreversibly purged from our active systems.
10. Third-Party Software Attribution
Portions of the Satkosh client software are distributed under the Apache License, Version 2.0. A copy of the licence is available at apache.org/licenses/LICENSE-2.0. Except as required by applicable law or agreed to in writing, such software is distributed on an "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied. Full attribution notices are supplied with the client software and in the product documentation.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal action, suit, or proceeding arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Nashik / Mumbai, Maharashtra, India.
